1. Parties
These Terms of Engagement (“Terms”) govern the relationship between TEPS (Tiling, Epoxy and Plumbing Services), a division of Bonke Bathi Mbuyisa (BBM) (Pty) Ltd, Registration No. 2026/496247/07 (“TEPS”, “we”, “us”) and the client (“you”, “the Client”) engaging our services.
2. Quotations
- All quotations are provided in writing and are valid for 30 days from the date of issue.
- Quotations are based on information provided at the time of site assessment. Any changes to scope may result in revised pricing.
- A signed acceptance of quotation is required before work commences.
- VAT and any applicable levies will be clearly indicated on all quotations.
3. Payment Terms
- A deposit of 50% of the total project value is required before work commences.
- The remaining balance is due upon completion and sign-off of the project.
- Payment must be made via EFT to the bank account provided on the invoice.
- TEPS reserves the right to suspend work if payments are not received as agreed.
- Late payments may attract interest at the prime lending rate plus 2%.
4. Scope of Work
- The scope of work is as defined in the accepted written quotation.
- Any additional work requested beyond the agreed scope will be quoted separately and requires written approval before proceeding.
- TEPS is not responsible for existing defects, structural issues, or pre-existing conditions not identified during the initial site assessment.
5. Timelines
- Project timelines are estimates based on the agreed scope and site conditions.
- TEPS will not be held liable for delays caused by factors beyond our control, including adverse weather, delays in material delivery, or access restrictions.
- The Client must ensure access to the site at agreed times.
6. Client Responsibilities
- The Client must provide safe and unobstructed access to the work area.
- The Client is responsible for removing personal belongings, furniture, and valuables from the work area prior to commencement.
- The Client must ensure that all necessary permissions, approvals, and body corporate consents are obtained before work begins.
- Water and electricity must be available on site at no cost to TEPS.
7. Workmanship Warranty
- TEPS warrants all workmanship for a period of 12 months from the date of project completion.
- This warranty covers defects arising from faulty installation workmanship only.
- The warranty does not cover damage caused by misuse, neglect, modifications by third parties, or normal wear and tear.
- Material warranties are subject to the terms of the respective manufacturers.
8. Cancellation
- Cancellation of an accepted quotation must be made in writing.
- If cancelled within 48 hours of commencement, the deposit is non-refundable.
- If work has already commenced, the Client will be liable for work completed to date plus any materials procured.
9. Liability
- TEPS liability is limited to the value of the contracted work.
- TEPS is not liable for indirect, consequential, or incidental damages.
- TEPS carries appropriate public liability insurance for all projects.
10. Dispute Resolution
In the event of a dispute, both parties agree to first attempt to resolve the matter amicably. If unresolved within 14 days, the matter may be referred to mediation or arbitration in accordance with the laws of the Republic of South Africa. The courts of South Africa shall have jurisdiction over any legal proceedings.
11. Governing Law
These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act No. 68 of 2008 and the National Building Regulations and Building Standards Act No. 103 of 1977.
